Conditions of Carriage

1. The conditions of carriage under air tickets relating to the limits of liability of the carrier for death or personal injury and in respect of loss of or damage to baggage are subject to the provisions of Warsaw conventions.

1a. Tour operators or travel agents or booking agents are obliged to ensure all passengers are made aware off all the terms and conditions described herein.

1b. Indigo Aviation retains the right to refuse boarding any passenger on  it's aircraft if the booking agent has not paid the outstanding amount due to Indigo Aviation Ltd.

2. Passengers are permitted a maximum baggage allowance of 25 kgs. per person unless otherwise indicated. Soft bags are strongly recommended. This allowance shall include all hand baggage. The carriage of excess baggage is at the sole discretion of the Company after taking into consideration the aircraft being used and the number of passengers booked. When excess baggage is carried it will be charged at the prevailing freight rate. Final decision on luggage allowance or any flight condition is solely up to the pilot in command.

3. Freight is carried strictly on a space availability basis. The company does not accept any liability for any direct or consequential cost arising from any delays in the carriage due to any reasons whatsoever. In the event of the freight being lost or damaged during carriage then the Company's liability is limited to a maximum of US $ 5 per kg.

4. Indigo undertakes to use it's best efforts to carry the passenger and his baggage with reasonable dispatch, but no particular time is fixed for the commencement or completion of carriage. Subject thereto, Indigo may, without prior notice, substitute, alternate carriers or aircraft and may alter or omit the stopping place previously agreed upon. Times indicated on brochures are approximate and not guaranteed.

5. No liability whatsoever is accepted towards passengers or hirers, their dependants or any other persons in respect of death, injury, sickness, damage or loss, whether sustained on board the aircraft, in course of any of the operations of flight, embarking, disembarking or otherwise. Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, servants and representative of carrier and any other person whose aircrafts is used by carrier for carriage and its agents, servants and representatives

6. In particular we point out that bags are not tagged and maintained by the airline like in large airlines. They remain always under the control of the customer who must not loose sight of them.

7. An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its agent

8. Payment in full to accompany bookings - seat reservation ONLY after payment in full.

9. Flights Cancellation: 100% charge if received less than 48 hours prior to departure. Tickets will be honored, subject to load basis, on subsequent flight. For flights as part of safari package, Indigo Aviation' general cancellation terms and conditions are applicable. Please note that all cancellations must be in writing.

10. Indigo reserves the right to use single or twin engine aircraft on any route.

11. Indigo Aviation Ltd's general terms and conditions displayed on the company website and the online booking system. Customer may demand a copy of same.

12. Flights may be changed or cancelled without prior notice. The Company is not responsible for any direct or consequential costs resulting from any delays to its services.

13. Tariffs are subject to change without prior notice

14. Check in time is 30 minutes before the flight: 15 minutes before flight your seat may be allocated to waitlisted or stand-by passengers.

15. Smoking is not allowed on any of our Aircraft.

16. All claim for any event to be received in writing by the company within 7 days from its occurrence. In case of dispute the Court of Law is Tanzania.

17. The Carrier does not take responsibility for delays and missed connection with other transporters, however, in those events where the travelers need to catch a connection, we strongly recommend agents to specifically inform the carrier and efforts will be made to assist the passengers in making to the connection on time. Such requests will be undertaken only if made in writing.

18. The carrier does not take responsibility for diversion from any destination due to weather limitations, and no refund will be given to passengers if an alternate airport is used. If flight is cancelled before departure due to weather consideration, the passenger is entitled to a full refund.

No Agent, servant or representative of the carrier has authority to alter, modify or waive any provision of this contract.
